INCLUDING CONSUMER INFORMATION AND INFORMATION ON DISTANCE SELLING
The Bloggercube GmbH, Amsinckstrasse 34, 20097 Hamburg, Germany ("Bloggercube") operates a platform ("the platform") at www.bloggercube.com, whose services can be used via various social media communication channels. The platform offers contact possibilities to Stars, Promis, Influencer, Blogger, YouTuber and other Idolen („Idole“) who offer entertainment, support and other services. In addition to these General Terms and Conditions (GTC), our General Terms of Use (EULA) and our Privacy Policy apply.
SCOPE OF USE
These GTC apply to the entire business transactions between Bloggercube and the user of the services offered by Bloggercube ("customer"), in particular, all consulting services offered on the platform are provided exclusively on the basis of these GTC, regardless of whether the customer registers separately beforehand or through which communication channels the customer uses the services.
Registered customers will receive a copy of these GTC immediately after registration by e-mail. In addition, the GTC can be called up at any time at www.Bloggercube.com/agb, saved and printed out by the customer.
SUBJECTS OF THE CONTRACT
Platform usage: Bloggercube offers customers the opportunity to use free and paid services via the platform. Registered customers are offered fee-based services at special conditions. A registration can be done online or by phone. A fee is not charged by Bloggercube for this. Through the registration, a contract of use is concluded between Bloggercube and the customer.
Services: The service we offer includes all Bloggercube products, features, apps, services, technologies and software that we provide to further Bloggercube's mission: To bring you closer to the people and things you care about (your idols). The service consists of the following service components:
Provide personalized ways to create content, connect, communicate, discover and contact: People are different. We want to strengthen your relationships through shared experiences that really matter to you. That's why we develop systems to determine who and what is important to you and others. We then use this information to help you create, find and contact content and to participate in experiences that are important to you. This includes highlighting features, offers, and accounts that you may be interested in based on the activities you and others perform on and off Bloggercube, and providing you with opportunities to learn more about Bloggercube.
Developing and using technology to help us provide consistent service to our growing community: Organizing and analyzing information for our growing community is a key aspect of our service. Much of our service consists of creating and using state-of-the-art technologies that help us personalize, protect and improve our service on an extraordinary scale for a very large global community. Technologies such as artificial intelligence and machine learning allow us to apply complex processes to our service. Automated techniques also help us to ensure the functionality and integrity of our service.
Providing consistent and seamless experiences on other Bloggercube products: Bloggercube is a company. They share technologies, systems, insights and information - including the information we have about you (read more in the (Privacy Policy) to provide better, safer, more secure services. In addition, we provide you with interaction opportunities on all Bloggercube products you use, as well as systems designed to provide a seamless and consistent experience across all Bloggercube products.
Ensure a robust global infrastructure for our service: In order to provide our global service, we need to store and transmit data on our systems around the world, including to countries outside of your country of residence. This infrastructure may be owned or operated by Bloggercube or its affiliates.
We connect you to brands, products and services that are important to you: We use information from Bloggercube and other products of the Bloggercube companies and third party partners to show you advertisements, offers and other sponsored content that we believe will be important to you. We also try to make such content as relevant as all your other experiences on Bloggercube.
Use of the Service: Bloggercube offers registered customers the possibility to get in contact with the idols via the available platform, services via telephone, video chat or chat with costs. Here costs arise for each individual service used. The customer is explicitly informed on the platform and before each individual use about the liability to pay costs and the amount of the costs. Prices shown are always inclusive of the legal value added tax and other taxes.
CONCLUSION OF CONTRACT, STORAGE OF CONTRACT TEXT
The contract is concluded in German language. All contracts are concluded by Bloggercube in its own name. Bloggercube does not save the text of the contract.
The contractual relationship regarding the free use of the platform comes into effect in case of an online registration of the customer on the platform - if the customer has deposited an email address - with receipt of the confirmation email sent by Bloggercube, otherwise with receipt of the registration confirmation sent by mail, in case of a telephone registration of the customer by confirmation of the registration by the Bloggercube employee making the telephone call. With the use of a fee-based service, the customer enters into another fee-based contractual relationship separate from the free platform usage contract.
The contractual relationship regarding the service via telephone, video chat or chat comes into effect in each case through the use of the fee-based service, namely in the case of a telephone or chat consultation with the establishment of a connection to the idol; in the case of use via email with the letter of the idol via email.
After logging on to the platform under "My Bloggercube", the customer can view all data provided by him/her during registration and make changes, as well as get an overview of the services used by him/her and the fees payable for these services and print these data.
RIGHT OF WITHDRAWAL FOR CONSUMERS
If the customer is a consumer, he has a right of revocation.
Note: If the customer makes use of advice via a telephone or Internet connection established by him, he has no right of revocation with regard to this advice. . You have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the date of conclusion of the contract. In order to exercise your right of revocation, you must:

inform us by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to withdraw from this contract. You can use the attached sample revocation form, which is not mandatory.
In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the end of the revocation period.
Consequences of the revocation
If you cancel this Agreement, we shall refund to you all payments we have received from you, including delivery charges (other than any additional charges arising from your choice of a delivery method other than the low-cost standard delivery method offered by us), immediately and no later than within fourteen days of the date on which we receive notice of your cancellation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.
If you have requested that the service be commenced during the cancellation period, you shall pay us a reasonable amount, which shall be proportionate to the proportion of the services already provided by the time you notify us of the exercise of the right of cancellation in respect of this Agreement compared to the total amount of services provided for in the Agreement.

LIABILITY
the liability of the provider for damages of the customer due to intentional or grossly negligent conduct of the seller, for fraud, for personal injury and damages under the Product Liability Act is unlimited in accordance with the statutory provisions. This also applies to damages caused by vicarious agents of the seller.
otherwise the liability of the seller for claims for damages is limited as follows: For damages caused by slight negligence, the seller is only liable to the extent that these are based on the violation of essential contractual obligations (cardinal obligations). Cardinal obligations are those contractual obligations whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner could trust. The liability of the provider for simple negligence according to this regulation is limited to the typically foreseeable damage.
The above limitations of liability in section X.2 also apply in favour of the Provider's vicarious agents.
the provider does not assume any responsibility for the contents provided by the users via www.bloggercube.com. The provider offers a platform at www.bloggercube.com to offer applicants and employers the possibility of contact, but does not participate in the communication between the users.
the provider has no influence on the transport of data via the internet or on the reliability of the user's internet connection and therefore assumes no liability in this respect.
EXEMPTION
The user undertakes to release the provider from claims of third parties of any kind resulting from his non-contractual acts of use and/or illegal and/or contract-violating behaviour of the user. The user undertakes to immediately provide the provider with all information necessary from the provider's point of view. The indemnification obligation also includes the obligation to indemnify the provider from the costs of a necessary and appropriate legal defense (e.g. court and attorney fees). Further rights and/or claims for damages of the provider remain unaffected. The user has the right to prove that the provider actually incurred lower costs than those claimed.
the above obligations of the user do not apply if the user is not responsible for the infringement in question.
TERMINATION OF THE USE/CONTRACT PERIOD
the user can deactivate his applicant profile at any time. Voluntary details in the applicant profile can be changed or deleted at any time using the corresponding functions in the user account.
for applicants: The applicant profile is available for registered companies on www.bloggercube.com for the duration of the contract if the user does not wish to deactivate it beforehand. Early deactivation at the request of the user does not lead to a refund of costs. The contract will not be automatically renewed. If the user wishes an extension of the contractual relationship, a new booking of the desired service is required.
for companies: The packages which can be ordered by companies are not bound to a certain term.
Both parties have the right to terminate the contract for good cause. The user's claim for repayment of fees already paid in advance upon termination is excluded. This does not apply if the user cancels the contract for an important reason for which the provider is responsible.
DATA PROTECTION
The privacy policy is to be read carefully. You can find it at www.bloggercube.com/datenschutz.
Certain sensitive data may not be disclosed in the profile on www.bloggercube.com and should not be disclosed by e-mail. Such information may include, but is not limited to, an identity card number, social security number, health data, information about ethnic origin, political, religious or philosophical beliefs, union membership and sexual orientation, and credit card number or bank account information.
FINAL PROVISIONS
The contract language is German.
The provider reserves the right to change or amend these general terms and conditions in the future. The user will be notified of such changes in good time before they come into force. If the user does not object to the changes within one (1) month after the announcement, the changes are considered accepted.
The provider reserves the right to change the functional scope of the offers on www.bloggercube.com and their general design or to offer different services, provided that this is not unreasonable for the user in individual cases.
German law applies, excluding private international law and the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.
If the user is a merchant, a legal entity under public law or a special fund under public law with its registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the registered office of the provider. All legal disputes will then be conducted before the regional court. If the user does not have a general place of jurisdiction in Germany or the EU, or if the user's place of residence or habitual abode is unknown at the time the action is filed, the exclusive place of jurisdiction for all disputes arising from this contract is the provider's place of business. The authority to also call upon the court at another legal place of jurisdiction remains unaffected by this.
The invalidity or ineffectiveness of individual provisions of these General Terms and Conditions shall not affect the validity of the remaining provisions.
